A will is a legal document which sets out an individual’s personal wishes, and how they want their Executor/s to deal with the distribution of their assets after they have passed away. A will sets out the names of the beneficiaries and should clearly state what each beneficiary (if more than one) is to receive. In the event of a primary beneficiary passing away before the will can be taken into effect, our clients often request that a secondary beneficiary takes the share which the primary beneficiary would have taken, had they been alive to receive it.

Joint Will

A Joint Will is signed by two or more people, and sets out each individual’s wishes as to the distribution of their property independently, but within the same Will Document.

Mirror Will

Mirror Wills are two separate wills, which may use precisely the same wording or may also use different wording but with the same intentions, therefore mirroring each other’s wishes.

Neither individual’s Will is binding on the other person. Each person is free to change their Will at any time if they need to, and without any need to notify the other person.

Living Will

A living will, also known as an advance decision or advance directive, is a legall document that states your wishes for medical care if you are unable to communicate them. 

A living will would generally include your name, address, date of birth, NHS number, values, and the treatments you would refuse. It can also include instructions about whether you want to receive certain treatments, even if they could lead to your death. 

A living will is only used if you lose the capacity to make or communicate decisions about your treatment. You should share a copy of your living will with your relatives, close friends, GP surgery, local hospital, and local ambulance trust. You should also review your living will regularly.
