Pre-action letters
The pre-action protocol for civil claims requires Claimants to issue a pre-action letter before issuing a court claim. The pre-action letter must set out the full details of the claim, including but not withstanding; a summary of the facts leading to the claim, the legal and factual basis for the claim, any amount claimed or an indication of the damages or losses caused (or likely to be caused) to the Claimant, and a reasonable time limit for response from the Defendant. If the pre-action protocol is not followed, there may be sanctions applied by the court for any failure to adhere to the rules.
